WEBVTT 00:00:00.000 --> 00:00:04.000 music 00:00:04.000 --> 00:00:08.000 I said no! 00:00:08.000 --> 00:00:12.000 Being sexually harassed or assaulted can affect a student's behavior, their grades, 00:00:12.000 --> 00:00:14.000 even how they see themselves in the world. 00:00:14.000 --> 00:00:16.000 I'm sorry I'm late. 00:00:16.000 --> 00:00:20.000 Oh, it's no problem. Are you okay? 00:00:20.000 --> 00:00:24.000 Yes? No...I mean, I don't know. 00:00:24.000 --> 00:00:26.000 Do you want to talk about it? 00:00:26.000 --> 00:00:30.000 I don't know, maybe. I don't know, 00:00:30.000 --> 00:00:40.000 Whether or not they talk about it is up to them, and as an employee at WOU, if they talk about it to you, there are certain things that the law requires you to do. 00:00:40.000 --> 00:00:44.000 Learn about mandatory reporting, to protect them, 00:00:44.000 --> 00:00:48.000 and yourself. 00:00:48.000 --> 00:00:52.000 Hello, my name is Charisse Laughery and I am the student conduct coordinator. 00:00:52.000 --> 00:00:56.000 And my name is Tina Fuchs, and I'm the Dean of Students. 00:00:56.000 --> 00:00:60.000 Today we'll be talking with you about sexual misconduct and mandatory 00:01:00.000 --> 00:01:04.000 reporter training. It's important to talk with you about these topics 00:01:04.000 --> 00:01:08.000 today, specifically as it relates to our policy, 00:01:08.000 --> 00:01:12.000 some of the types of violations with regard to sexual misconduct, 00:01:12.000 --> 00:01:16.000 and consent. It's also important to frame 00:01:16.000 --> 00:01:20.000 the discussion with a review of our policy as outlined in 00:01:20.000 --> 00:01:24.000 the Code of Student Responsibility. Standard 15a, 00:01:24.000 --> 00:01:28.000 Sexual Misconduct, is considered non-consensual sexual contact 00:01:28.000 --> 00:01:32.000 or the threat to have non-consensual sexual contact. 00:01:32.000 --> 00:01:36.000 In all cases of sexual activity between our students, 00:01:36.000 --> 00:01:40.000 consent must be freely given. This also includes 00:01:40.000 --> 00:01:44.000 any incident of sexual exploitation. The other 00:01:44.000 --> 00:01:48.000 part of the Code of Student Responsibility related to sexual misconduct 00:01:48.000 --> 00:01:52.000 is sexual harassment. Any allegation of sexual 00:01:52.000 --> 00:01:56.000 misconduct is considered gender-based discrimination, and 00:01:56.000 --> 00:01:60.000 falls under the umbrella of sexual harassment. What this 00:02:00.000 --> 00:02:04.000 means is that any student charged with any allegation of sexual 00:02:04.000 --> 00:02:08.000 misconduct will also be charged with an allegation of 00:02:08.000 --> 00:02:12.000 sexual harassment. There are a variety of types 00:02:12.000 --> 00:02:16.000 of sexual misconduct offenses. Sexual harassment, 00:02:16.000 --> 00:02:20.000 of course, is one that we've just talked about. Gender-based 00:02:20.000 --> 00:02:24.000 verbal or physical conduct that unreasonably 00:02:24.000 --> 00:02:28.000 interferes with or deprives someone of educational access, benefits, 00:02:28.000 --> 00:02:32.000 or opportunities. WOU offers an 00:02:32.000 --> 00:02:36.000 online training to help faculty and staff understand 00:02:36.000 --> 00:02:40.000 and identify forms of sexual harassment. The online 00:02:40.000 --> 00:02:44.000 training can be accessed by going to the WOU human 00:02:44.000 --> 00:02:48.000 resources webpage. Non-consensual sexual intercourse 00:02:48.000 --> 00:02:52.000 is another type of sexual misconduct. 00:02:52.000 --> 00:02:56.000 Examples include sexual assault, sexual penetration, 00:02:56.000 --> 00:02:60.000 and rape. Non-consensual 00:03:00.000 --> 00:03:04.000 sexual contact is another type of sexual misconduct at Western 00:03:04.000 --> 00:03:08.000 Oregon University. This includes any intentional 00:03:08.000 --> 00:03:12.000 sexual touching, however slight, with any object, by a person 00:03:12.000 --> 00:03:16.000 upon a person without their consent. Examples 00:03:16.000 --> 00:03:20.000 include touching of the breasts, genitalia, or other parts 00:03:20.000 --> 00:03:24.000 of the body when intent is sexual in nature. 00:03:24.000 --> 00:03:28.000 And finally, sexual exploitation. Sexual exploitation 00:03:28.000 --> 00:03:32.000 is another type of sexual misconduct offense. It 00:03:32.000 --> 00:03:36.000 occurs when someone takes non-consensual or abusive sexual 00:03:36.000 --> 00:03:40.000 advantage of another of his or her own advantage or benefit, 00:03:40.000 --> 00:03:44.000 or to benefit or advantage anyone other than the one being 00:03:44.000 --> 00:03:48.000 exploited. And that behavior does not otherwise 00:03:48.000 --> 00:03:52.000 constitute one of the other sexual misconduct offenses. 00:03:52.000 --> 00:03:56.000 Let me give you some examples of sexual exploitation. 00:03:56.000 --> 00:03:60.000 They include non-consensual video or audiotaping of a sexual activity, 00:04:00.000 --> 00:04:04.000 engaging in what we call "Peeping 00:04:04.000 --> 00:04:08.000 Tom-ery," knowingly transmitting a sexually 00:04:08.000 --> 00:04:12.000 transmitted infection or HIV, or 00:04:12.000 --> 00:04:16.000 prostituting another student. The most important thing that we can 00:04:16.000 --> 00:04:20.000 convey is that you should gain consent in all 00:04:20.000 --> 00:04:24.000 sexual situations. 00:04:24.000 --> 00:04:28.000 music 00:04:28.000 --> 00:04:32.000 music 00:04:32.000 --> 00:04:36.000 music 00:04:36.000 --> 00:04:40.000 music 00:04:40.000 --> 00:04:42.000 music 00:04:42.000 --> 00:04:44.000 Come on, you ready? 00:04:44.000 --> 00:04:47.000 I mean, I'm almost ready. 00:04:47.000 --> 00:04:51.000 We're gonna be late. 00:04:51.000 --> 00:04:57.000 Nah, we got time. 00:04:57.000 --> 00:04:59.000 Later. 00:04:59.000 --> 00:04:60.000 Promise? 00:05:00.000 --> 00:05:02.000 Yeah, I promise. 00:05:02.000 --> 00:05:03.000 Alright. 00:05:03.000 --> 00:05:07.000 Yeah. 00:05:07.000 --> 00:05:09.000 That was fun. 00:05:09.000 --> 00:05:20.000 Yeah? No matter how long you've been together, 00:07:36.000 --> 00:07:40.000 consent is needed every time. 00:07:40.000 --> 00:07:44.000 Whose room is this? 00:07:44.000 --> 00:07:48.000 kissing sounds 00:07:48.000 --> 00:07:52.000 grunting 00:07:56.000 --> 00:07:60.000 kissing sounds 00:08:00.000 --> 00:08:04.000 kissing sounds, belt unbuckling 00:08:04.000 --> 00:08:08.000 kissing sounds 00:08:08.000 --> 00:08:12.000 Oh, wait! 00:08:12.000 --> 00:08:16.000 Oh, no, it's fine, I'm on the pill. 00:08:16.000 --> 00:08:20.000 Wait, I just...I think it'd be better, you know. 00:08:20.000 --> 00:08:24.000 Don't you wanna feel me? 00:08:24.000 --> 00:08:28.000 Well, yeah, I just...you know, I think it'd be safer. 00:08:28.000 --> 00:08:32.000 Okay. Consent can be given 00:09:20.000 --> 00:09:24.000 and can be revoked at any time. The state of Oregon defines 00:09:24.000 --> 00:09:28.000 consent as a person who is considered incapable of giving 00:09:28.000 --> 00:09:32.000 consent to any sexual act, if the person is under the age of 18, 00:09:32.000 --> 00:09:36.000 mentally defective, mentally incapacitated, or physically 00:09:36.000 --> 00:09:40.000 helpless. We go on to define consent for our students 00:09:40.000 --> 00:09:44.000 as this: consent is informed, knowing and 00:09:44.000 --> 00:09:48.000 voluntary. Consent is active, not passive. 00:09:48.000 --> 00:09:52.000 Silence, in and of itself, cannot be interpreted as consent. 00:09:52.000 --> 00:09:56.000 And consent can be given by words or actions, as long as 00:09:56.000 --> 00:09:60.000 those words and action create mutually understandable permission 00:10:00.000 --> 00:10:04.000 regarding the conditions of sexual activity. 00:10:04.000 --> 00:10:08.000 Consent to one form of sexual activity cannot imply consent to other forms of 00:10:08.000 --> 00:10:12.000 sexual activity. Previous relationship or consent cannot 00:10:12.000 --> 00:10:16.000 imply consent to future sexual acts. And ability to 00:10:16.000 --> 00:10:20.000 give clear consent - so that means not impaired by alcohol, drugs, 00:10:20.000 --> 00:10:24.000 disability, or injury. Consent can be withdrawn 00:10:24.000 --> 00:10:28.000 at any point in the ongoing behavior. 00:10:28.000 --> 00:10:31.000 music
