I also serve as the Chief Conduct Officer 00:00:12.000 --> 00:00:16.000 here at Western Oregon University and I'm here to talk 00:00:16.000 --> 00:00:20.000 to you today about the student conduct process as it relates 00:00:20.000 --> 00:00:24.000 to sexual assault reports. There are five 00:00:24.000 --> 00:00:28.000 steps involved in this process. The first step is 00:00:28.000 --> 00:00:32.000 the reporting process. Generally the report comes 00:00:32.000 --> 00:00:36.000 to the Office of Student Conduct in a variety of ways. 00:00:36.000 --> 00:00:40.000 Either it's self-reported by the survivor 00:00:40.000 --> 00:00:44.000 or the Office of Student Conduct may receive an anonymous report 00:00:44.000 --> 00:00:48.000 and in fact the Office of Student Conduct 00:00:48.000 --> 00:00:52.000 may receive a formal report that was filed with Campus 00:00:52.000 --> 00:00:56.000 Public Safety or the Monmouth Police Department. 00:00:56.000 --> 00:00:60.000 Once the Office of Student Conduct receives this report, we 00:01:00.000 --> 00:01:04.000 meet with the survivor and talk with the survivor about the options 00:01:04.000 --> 00:01:08.000 available to them. Once we have information from the 00:01:08.000 --> 00:01:12.000 survivor, we meet with the student who 00:01:12.000 --> 00:01:16.000 we identify as our alleged offender. The offending student 00:01:16.000 --> 00:01:20.000 is charged with allegations of misconduct 00:01:20.000 --> 00:01:24.000 and becomes what we call the charged student. 00:01:24.000 --> 00:01:28.000 Interim sanctions are generally assigned at this point to 00:01:28.000 --> 00:01:32.000 the charged student pending a hearing. Interim sanctions can include 00:01:32.000 --> 00:01:36.000 a no contact order, where the charged student may not contact 00:01:36.000 --> 00:01:40.000 the survivor, removal from the residence hall 00:01:40.000 --> 00:01:44.000 if the charged student lives on campus, a change in course schedule 00:01:44.000 --> 00:01:48.000 if the charged student and the survivor share 00:01:48.000 --> 00:01:52.000 a class together, or a change in work schedule 00:01:52.000 --> 00:01:56.000 if they work together on campus, or 00:01:56.000 --> 00:01:60.000 they may be removed from campus altogether. Then the Office 00:02:00.000 --> 00:02:04.000 of Student Conduct interviews any witnesses that might be 00:02:04.000 --> 00:02:08.000 involved in the process. Once the investigation 00:02:08.000 --> 00:02:12.000 is completed, the Student Conduct Office will coordinate 00:02:12.000 --> 00:02:16.000 a hearing. The charged student, the survivor, and 00:02:16.000 --> 00:02:20.000 any witnesses, if applicable, are notified of the hearing date, 00:02:20.000 --> 00:02:24.000 time, and location. Student Conduct will make accomodations 00:02:24.000 --> 00:02:28.000 for the survivor to participate in the hearing at a level 00:02:28.000 --> 00:02:32.000 where the survivor feels safe. The hearing is help with 00:02:32.000 --> 00:02:36.000 the Student Conduct Committee. The charged student and 00:02:36.000 --> 00:02:40.000 the survivor may present their case to the hearing committee. 00:02:40.000 --> 00:02:44.000 The hearing committee with hear all of the information that is presented 00:02:44.000 --> 00:02:48.000 at the hearing and then the hearing committee will make a decision 00:02:48.000 --> 00:02:52.000 as to whether or not the allegations should be upheld or dropped. 00:02:52.000 --> 00:02:56.000 If any of the allegations or charges are upheld, 00:02:56.000 --> 00:02:60.000 the charged student is assigned sanctions. 00:03:00.000 --> 00:03:04.000 The purpose of the sanctions, or the goals I should say of 00:03:04.000 --> 00:03:08.000 the sanctions, is to one, stop the behavior. Make sure 00:03:08.000 --> 00:03:12.000 that the behavior no longer occurs and then prevent 00:03:12.000 --> 00:03:16.000 any recurrence from that behavior happening again. 00:03:16.000 --> 00:03:20.000 The other goal of sanctioning is to create 00:03:20.000 --> 00:03:24.000 a process that can help the survivor heal from the experience. 00:03:24.000 --> 00:03:28.000 The central sanctions that can be assigned if 00:03:28.000 --> 00:03:32.000 the charges are upheld include disciplinary probation, 00:03:32.000 --> 00:03:36.000 which is a formal warning to the charged student. 00:03:36.000 --> 00:03:40.000 A sanction of restraint or a no contact order may remain in place 00:03:40.000 --> 00:03:44.000 following the hearing. A change in class schedule, again 00:03:44.000 --> 00:03:48.000 if the students share the same class or class schedule, 00:03:48.000 --> 00:03:52.000 removal from the residence halls if the student is 00:03:52.000 --> 00:03:56.000 an on campus student, suspension from the university, 00:03:56.000 --> 00:03:60.000 or expulsion from the university. All of these sanctions 00:04:00.000 --> 00:04:04.000 vary depending upon the allegations that were made against the student 00:04:04.000 --> 00:04:08.000 and those allegations that were upheld. After 00:04:08.000 --> 00:04:12.000 the hearing, the charged student has the option to appeal the decision. 00:04:12.000 --> 00:04:16.000 The survivor as well has the option to appeal 00:04:16.000 --> 00:04:20.000 the decision reached by the committee. Once the appeal 00:04:20.000 --> 00:04:24.000 process has completed, all sanctions are put in place 00:04:24.000 --> 00:04:28.000 and the case is closed. The Office of Student Conduct 00:04:28.000 --> 00:04:32.000 then follows up with the survivor to ensure that the survivor has 00:04:32.000 --> 00:04:36.000 support.
